The Small Claims Court exists for exactly the situation most small businesses find themselves in: an amount that is real money to them and too small to justify an attorney.
It is free to bring a claim, no legal representation is allowed on either side, and the process is designed for people without legal training.
What it can and cannot do
It handles claims up to a monetary limit, which changes periodically — check the current figure before assuming your claim qualifies. Where a debt is larger, you can sometimes abandon the excess to bring it within the limit, which is worth considering against the cost of the alternative.
It does not handle every kind of matter. Certain claims are excluded, and there are limits on who may be sued. Notably, the court is generally for claims against individuals and certain entities rather than every kind of company, so confirm before you invest time.
The process
- Send a letter of demand and allow the required period to elapse. This is a prerequisite, not a formality.
- Go to the clerk of the court with your documents. They issue a summons.
- The summons is served on the other party.
- Both sides attend on the date, and the Commissioner hears the matter directly from the people involved.
There are no lawyers, no formal pleadings and no argument about procedure. The Commissioner asks questions of both parties and decides.
What actually wins
Documents. The quote or agreement, the evidence that the work was done or the goods delivered, the invoice, and the record of your attempts to collect.
A claimant who arrives with a folder in order, in date sequence, is in a very strong position against one who arrives with a story. This is the whole reason to write things down at the time, however small the job seemed.
Realistic expectations
Judgment is not payment. If the other party still does not pay, enforcing the judgment is a further process with its own cost, and it can only extract what actually exists.
Bring a claim against somebody who can pay and is choosing not to. Against somebody who genuinely has nothing, a judgment is a piece of paper, and the time might be better spent elsewhere.
The practical value
Many claims settle once the summons arrives, because the other party now has a date to attend and a decision to face. That alone justifies the process for a great many small businesses.
And it costs you a morning rather than a fee, which changes the arithmetic on debts that would otherwise simply be written off.
