@annelize_botha CIPC trademark examination and registration still takes roughly 12 to 18 months from filing to final certificate (assuming no opposition during the 3-month Patent Journal advertisement window). However, your priority date is locked in the day your application is filed! That filing receipt is usually enough for a trademark attorney or specialist like @namebrand or @legalese to send a formal cease-and-desist or submit a Takealot IP takedown notice if you also have clear prior use.

@zelda_rustenburg, Agree with @trademarktaryn. Do a proper phonetic and visual similarity search in Class 3 (cosmetics/skincare) and Class 35 (retail/online store) before you file so you don't wait 9 months for an official office action only to discover an existing mark blocking yours.

@gqeberhamarine Never accept a PDF COIDA Letter of Good Standing at face value anymore. Every legitimate Compensation Fund LOGS has a certificate number and QR/verification reference that you can check directly on the Department of Employment and Labour online verification portal in 30 seconds. If it doesn't validate on the CompEasy portal, they do not walk onto site.

@psira_watchdog, And for the B-BBEE EME/QSE sworn affidavit that @coidafixer mentioned: check that (1) the financial year-end date on the affidavit actually matches their CIPC records, (2) the deponent signed on the exact same date as the Commissioner of Oaths stamp, and (3) the percentage Black ownership and turnover bracket are ticked, not left blank. Procurement auditors reject affidavits every week over mismatched dates.

@chefmpho_za In Montague Gardens / Milnerton, the Environmental Health Practitioner (EHP) usually schedules the site inspection within 10 to 15 working days of your complete application, provided your zoning certificate allows food preparation. The two things that delay first-time pass in Cape Town are: (1) no dedicated hands-free handwash basin with hot and cold running water right in the prep zone (separate from the dishwashing sink), and (2) missing pest-control bait station service records and food-handler medical/training certificates.

@dawid_joubert, To add to @spiceroutecatering: if you're roasting coffee on-site in Montague Gardens, check with the City's Air Quality officer whether your roaster's drum capacity requires an afterburner or stack emission clearance. Under 5kg batch roasters usually fly through, but 15kg+ drums get scrutinized.

What @michelle_wessels and @caitlin_rossouw said is spot on. For most owner-managed companies, reimbursing actual business fibre, cell and direct equipment costs directly inside the company while leaving the property itself out of the rental structure avoids the CGT headache altogether.

@tygerbergtax 100% split the distribution board first before you buy a single inverter. Industrial compressors and direct-on-line motors have massive inrush currents (up to 6x rated kW) that will trip a hybrid inverter instantly unless they have VSDs (Variable Speed Drives). Put your office, server rack, lighting and control electronics on the essential backup bus, and if the 11kW machine must run on backup, fit a soft-starter/VSD and look at parallel 3-phase Deye 12kW or Victron Quattro units with at least 30kWh of LiFePO4 rack batteries.

@braaimaster_gp, Agreed with @solarguy_pta. Also run a 7-day data logger on your incoming Ekurhuleni 3-phase supply before quoting. Half the workshops we audit in Germiston have terrible phase imbalance that needs redistributing before a 3-phase hybrid inverter goes in, and your insurer will insist on a supplementary SANS 10142-1 CoC signed off by a registered installation electrician.

@ashwin_singh_dbn Section 198B of the Labour Relations Act applies to employees earning below the BCEA threshold (currently R254,371.67 per year), BUT Section 198B(4)(d) explicitly permits a fixed-term contract longer than 3 months if the person is employed to work exclusively on a genuine, limited-duration project. The critical rule is that the contract must be in writing and must state the exact project name and the objective event that ends the contract (e.g. 'practical completion and client sign-off of Phase 2 eThekwini Fibre Rollout'), rather than just rolling over vague 3-month dates.

@elizef_bfn, To add to @ccmawhisperer's answer: never take a technician on a 'project' contract and quietly move them onto general maintenance work for other clients without issuing a new agreement, because that destroys the genuine limited-duration defence at the CCMA.

PayFast vs Peach Payments vs Stitch for a WooCommerce store selling high-ticket B2B equipment?

We're launching an online ordering portal for commercial catering spares in Johannesburg. Average basket size is R8,500 to R35,000. Card fees at 3%+ eat into our margin fast on R30k orders, so we need reliable Instant EFT / PayShap alongside 3D Secure card payments. Which gateway has the best settlement speed and lowest failure rate right now?

KznPlumbPro · 31 Aug 2026

@cobus_potgieter, We run three high-AOV WooCommerce stores and moved two of them to @peachpayments this year. Their WooCommerce plugin handles webhook retries much cleaner when a buyer's mobile network drops mid-3DS, and their support team in Cape Town actually picks up the phone when you need a custom settlement or fee review once your monthly volume crosses R250k.

Sanet · 31 Aug 2026

@kznplumbpro, +1 for @peachpayments on higher basket sizes. Also add a 'Request Pro-Forma Invoice (Instant PDF)' button on baskets over R15,000, about 40% of SA procurement teams still need a PDF tax invoice with banking details so their finance person can load a dual-approval EFT on FNB or Investec.

@riaan_venter Yes, CIPC now enforces a hard stop on annual returns until the BO filing is accepted. For a simple 50/50 private company with no trust above it, you need: (1) a certified copy of both directors' green barcoded IDs or smart ID cards (certified within the last 3 months), (2) a signed mandate letter on company letterhead authorizing the filer, (3) your updated securities register, and (4) the disclosure form showing each natural person holding >5%. Platforms like @infodocsza also automate the share register formatting if you don't have one on hand.

Buhle Khumalo · 30 Aug 2026

@kzntaxlady, Spot on from @cipcwhisperer. One thing that tripped us up last month: if you use a smart ID card, make sure BOTH sides of the card are copied onto the same page before the Commissioner of Oaths stamps it. CIPC rejected ours the first time because only the front was visible.

At what turnover point does voluntary VAT registration actually make sense for a B2B contractor?

We run a small electrical and solar contracting team in Centurion doing around R680k a year right now. Almost all our corporate clients are VAT-registered and keep asking for tax invoices, plus we spend heavily on inverters and cabling every month. Is voluntary VAT registration worth the extra bi-monthly admin before hitting the R1m compulsory threshold?

Reply

SpiceRouteCatering · 29 Aug 2026

Completely agree with @riaz_patel. One practical tip for Centurion/Pretoria SARS applications: have your latest 3 months stamped bank statements, signed client SLAs or invoices totaling over R50k, and a municipal utility bill for your business premises ready before you submit the RAV01 update, otherwise SARS puts it into a verification queue for 21 business days.

Reply

KarooBeanCounter · 30 Aug 2026

@riaz_patel, Also remember to set aside the output VAT in a separate call account the day an invoice is paid. The biggest cash-flow trap for growing contractors is accidentally spending SARS's 15% on stock before the 25th of the second month.
